1. Overview

These Terms & Conditions apply to all commissions, services, and products provided by Aimee Black (Aimee Black Art). By placing an order or making a payment, you agree to these terms.

 

2. Custom Artwork Commissions

All artworks created are custom, hand-painted pet portraits based on photographs supplied by the client.

Due to the bespoke nature of the work:

• Each artwork is unique and created specifically for the client

• Artistic interpretation may occur

• Results may vary from reference photographs

 

3. Booking & Payment

To secure a commission, a non-refundable deposit as agreed at time of booking is required.

• Full payment or final balance is due prior to dispatch of the completed artwork

• Work will not commence until the deposit is received

• Final delivery may be withheld if final payment is not received. 

 

4. Client Photos & Approval

Clients are responsible for providing clear, suitable reference images.

• The artist will advise if additional photos are required

• Final artwork is created based on approved references

• Once artwork is completed, minor adjustments may be offered at the artist’s discretion prior to final delivery

 

5. Turnaround Times

Estimated completion times will be provided at the time of booking.

• Turnaround times are approximate and may vary depending on workload

• The artist will communicate any significant delays

 

6. Cancellations & Refunds

Due to the custom nature of the work:

• Deposits are non-refundable

• Cancellations after work has commenced are not eligible for refund.

• If the artist is unable to complete the commission for reasons outside the client’s control, a refund will be provided for any portion of work not yet completed at the time of cancellation or inability to proceed.

 

7. Shipping & Delivery

If physical artwork is shipped:

• Shipping times are separate from creation timeframes

• The artist is not responsible for delays caused by postal services or couriers

• Works are carefully packaged, however responsibility for damage in transit lies with the carrier once dispatched

• The cost of shipping will be the responsibility of the client (if not otherwise agreed). The cost of shipping is confirmed at the time of booking or prior to delivery. 

 

8. Copyright & Usage

All artworks remain the intellectual property of Aimee Black unless otherwise agreed.

• The artist retains the right to photograph and use images of completed artworks for portfolio, marketing, products, and social media unless the client requests otherwise in writing

• Clients may not reproduce, sell, or commercially use the artwork without permission

 

9. VIP Offer Terms & Conditions

The VIP Offer (“Offer”) refers to a promotional bonus mini artwork provided as part of selected portrait commission bookings with Aimee Black. 

By accepting or claiming this Offer, you agree to the following terms:

Eligibility

• The VIP Offer is available only to clients who are specifically invited or qualify through an eligible promotion or landing page.

• The Offer is limited to one per qualifying portrait commission unless otherwise stated.

• The Offer is not transferable, exchangeable, or redeemable for cash.

 

Offer Details

• The VIP Offer includes one complimentary mini artwork based on the same subject as the main commissioned portrait.

• The style, size, composition, and artistic interpretation of the mini artwork will be determined by the artist.

• The mini artwork is intended as a companion piece and may differ in detail or finish compared to the main portrait.

 

Timeframe & Validity

• To claim the VIP Offer, clients must confirm their portrait booking within 60 days of receiving the offer unless otherwise specified in writing.

• After this period, the Offer may expire and is no longer guaranteed.

• The artist reserves the right to withdraw or amend the Offer at any time for future promotions, but confirmed bookings will be honoured under the terms active at the time of booking.

 

Booking Requirements

• The VIP Offer is only valid once a deposit has been received and a commission booking has been confirmed.

• Standard commission terms and conditions (including payment, turnaround times, and cancellation policy) also apply to any booking made under this Offer.

 

Changes & Substitutions

• The artist reserves the right to substitute materials, techniques, or presentation style for the mini artwork if required for artistic or practical reasons.

• The Offer cannot be exchanged for a discount, upgraded artwork size, or alternative service.

 

Limitations

• The VIP Offer applies only to eligible commissions and cannot be combined with other promotional discounts unless explicitly stated.

• If a commission is cancelled or refunded, the VIP Offer is void.

 

10. Privacy

Personal information collected (such as name, email, and photos) is used solely for the purpose of fulfilling your order and communication.

We do not sell or share personal information with third parties except where required to complete your order (e.g. shipping providers). See our privacy policy. 

 

11. Liability

While every care is taken in the creation and delivery of artwork, Aimee Black is not liable for indirect or consequential loss arising from use of services or products.
